Personal Injury
Our Fees
As part of the settlement of your claim, Belmont Legal will negotiate on your behalf to achieve a settlement that will cover most of your out-of-pocket expenses and legal fees.
Belmont Legal offers a “no win, no fee” service for most personal injury claims relating to our professional fees.
During your initial meeting to discuss your potential claim, we will provide advice on exactly what a “no win, no fee” retainer with Belmont Legal means and what to expect throughout the processing of your claim.
Calculating Your Legal Costs
In most cases, legal fees for personal injury claims are charged under the Legal Practitioners (Supreme Court) (Contentious Business) Determination, generally known as the Supreme Court Scale. The current scale can be found here.
Each case is different as each claimant’s situation may vary, such as the extent of their injuries, seriousness, age and occupation.
Following your initial meeting, we will provide you with confirmation of our advice which will include an estimated cost breakdown based on industry experience and taking into consideration your instructions. Some matters that may affect our initial cost estimate include the attitude of the insurer and when and how your claim is settled.
Your initial meeting with Belmont Legal is obligation free, and you will not be charged for that meeting if you do not engage our services.
Commercial Matters
Our initial consultation fee for a one-hour appointment is $495 incl. GST.
When you contact Belmont Legal to seek our advice and arrange for an initial meeting, we encourage you to provide information to us prior to the meeting that may assist us in maximising the time we spend together.
Wills and Probate Matters
Although no Will is truly a “simple” Will, our fee for a “simple” Will is $800 incl. GST for a single Will and $1320 incl. GST for partners’ Wills, which are substantially the same.
However, if your circumstances involve blended families, property held in trusts, SMSF etc., we will provide a quote for those services.
Enduring Power of Attorney and Enduring Power of Guardianship
If you require enduring powers of attorney and enduring powers of guardianship, our fees are $220 incl. GST per document.
A discount may apply to pensioners and holders of a current seniors card.
